Can you drive with an expired inspection sticker in Virginia?

Driving on an expired Virginia inspection sticker is an offense every day the car is on the road, but since 2021 police cannot stop you for the sticker alone until the fourth month. What that rule actually means, and how to get legal fast.

Short answerNo, not legally. Under Virginia Code § 46.2-1157, every day a vehicle is driven or parked on a public highway without a valid inspection is a separate offense. What changed in 2021 is enforcement: an officer cannot stop you solely for an expired sticker until the first day of the fourth month after it expired. If you are stopped for anything else, the sticker can be cited from day one.

When does the sticker expire?

The sticker shows a month and year. The car is legal through the last day of that month and out of compliance the next morning. There is no grace period written into the law.

What the "fourth month" rule actually says

The statute reads: "No law-enforcement officer shall stop a motor vehicle due to an expired vehicle inspection sticker until the first day of the fourth month after the original expiration date." Evidence found during a stop that violates that rule is inadmissible.

Three things people get wrong about it:

1. It is not a grace period. The offense exists from the first day. The rule only limits what an officer can use as the reason for a stop.
2. It doesn't protect you during any other stop. Speeding, a broken tail light, a rolling stop: once you are pulled over for something else, the expired sticker is fair game.
3. It runs out. A sticker that expired in March becomes a stop-worthy sticker on July 1.

Parked cars count too. The law covers vehicles "operated or parked on any highway," so a car sitting on a public street with an expired sticker is in the same position.

What happens if I'm cited?

An expired-inspection citation is a traffic infraction handled through the general district court in the locality where it was issued. Fine amounts are set by the court's schedule; many courts will dismiss or reduce the charge if you show proof the car was inspected before the court date, but that is the court's discretion, not a right. The citation does not replace the inspection. You still need the sticker.

The fastest way to get legal

1. Any licensed station will do. You are not tied to where you were inspected last year. Look for the official Virginia State Police station sign.
2. Go early in the day, mid-week, and mid-month. Month-end is the crush, because every sticker in the state expires on a month boundary.
3. If you think it might fail, go anyway. A rejection sticker is valid for 15 days, carries no travel restriction, and reinspection at the same station costs at most $1.
